Is Age Discrimination Hard To Prove?

By Corey Hanrahan

Is age discrimination hard to prove? The answer to this question depends on a lot of factors. One factor is the length of an employee’s performance. To prevail on a claim of age discrimination, you must show, by direct or circumstantial evidence, that an adverse employment action was taken against you because of your age. Employers will often point to alleged performance deficiencies to defend themselves against an age discrimination claim. Therefore, oftentimes, a long history of great performance and accommodations can go a long way in disproving alleged performance deficiencies.

When employers discriminate against workers based on their age, they deny them access to jobs that could end up being a great fit for them. Employers can also miss out on hiring people who would be incredibly valuable assets to the company.

Age discrimination is a real problem for older employees. This can take many forms, from being treated differently by managers, to receiving lower pay raises, to being passed over for promotions.
