How Do You Deal With An Employer That Won't Pay You?

By Corey Hanrahan

How do you deal with an employer that won’t pay you? If your employer is not paying you, and you believe it may be unintentional, you may make a report to the employer advising of the nonpayment of wages. There may be a situation where the employer has mistakenly not paid you, or possibly there was an error with the payroll processing company that led to you not being paid.

“…Even if you are working off the clock due to being overworked, it is illegal for the employer to not pay you for that work. Under California law, employers are required to compensate you for off-the-clock work if the employer knows or should have known that you were working off-the-clock

If you believe that the nonpayment of wages is intentional, then hiring a skilled and knowledgeable employment attorney who knows the intricacies of California’s wage and hour laws is probably best. Even if you are working off the clock due to being overworked, it is illegal for the employer to not pay you for that work. Under California law, employers are required to compensate you for off-the-clock work if the employer knows or should have known that you were working off-the-clock.

But you should always make sure to report all of your hours worked to your employer. This will prevent the employer from taking the position, “We had no idea you were working off the clock. We have a very strict policy against working off the clock.” If you found yourself in that position, and you could not prove that the employer knew or should have known you were working off the clock, you may not be able to obtain compensation for that time.

Attorney Corey Hanrahan has helped many employees seek wages they were owed, and all applicable penalties associated with the employer’s actions. If you are owed wages from your employer or former employer, contact The Hanrahan Firm for a free consultation to see what we can do for you.
