How Hard Is It To Win A Discrimination Lawsuit?

By Corey Hanrahan

How hard is it to win a discrimination lawsuit? Admittedly, due to the proof required, discrimination lawsuits can be difficult. In order to win a discrimination lawsuit, the employee must prove that he/she was discriminated against based on race, gender, disability, sex, etc. This can sometimes be a difficult task because employer’s and wrongdoers generally deny the claims and do not admit to discrimination of any kind.

It is also important to note that small employers are not subject to the anti-discrimination provisions of California’s Fair Employment and Housing Act. The anti-discrimination provision does not apply to employers of fewer than five persons.

The employee has the burden of proof in discrimination cases, which means that employees have to show that their employer showed favoritism toward other employees based on a protected characteristic (e.g., age, race, gender, or another factor). This can be difficult when there are so many factors involved with employment decisions and it is hard to prove exactly why one employee was chosen over another.

Having a skilled and experienced discrimination lawyer on your side is one way to level the playing field on these difficult discrimination cases. If you have any questions about potential discrimination at work, contact The Hanrahan Firm for a free consultation.
